Life is a maze and many times people take wrong turns and get misled, then there come problems, disputes & arguments. It’s better to find a solution to your problems rather than avoiding them because when we avoid our problems they only grow.

Mediations can either be “Transformative” or “Facilitative”. Facilitative mediation, as the name suggests, facilitates debate in which mediator with a neutral attitude easily leads both the parties together to a equally agreed solution by mounting communication and problem solving skills during sessions. In these techniques the mediator necessary should not only be tranquil and extremely skilled, but also a loving & a secret person capable of supporting both the parties on emotional front also. A mediator in such cases is predictable to step in shoes of clients with neutral attitude. The mediator’s role here is to construction the process in such a way that lucid needs are met in the common anxiety of both the parties. The end product is strong approval as the final decision is of the clients covering all the important issues. In terms of money and time Facilitative & Transformative methods are logical.
Many incompetent lawyers usually refer to Mediation as “Settlement Conference” in which lawyers tries to show that their proof as are apt as per legal theories and tend to power Mediator’s decision in his client’s favor. Other technique which is quiet well-liked is “Evaluative” mediation where lawyer cum mediator advices the parties about court’s point of view of the case and the result will be a kind of obligatory decision based on mediator’s study. After the agreement, the court official procedure is processed. Evaluative mediation & Settlement Conference is a kind of cooperation due to absolute participation of lawyer and also court is being referred to, facts are being required, it’s a kind of law settlement which necessitates complete legal formalities. During Evaluative Mediation & Settlement discussion the moving issues are not taken into deliberation. Moreover, the time and cost involved in these procedures is also not viable. As the final decision is of client as well as lawyer and doesn’t cover all the issues, it lacks complete contentment.
