An Individual Voluntary Arrangement or in short the IVA is a legal binding and formal agreement between someone who owes money (the borrower) and the people he or she owes money to (lenders). This proposal sets out how the debtor is going to repay the creditors, usually over a period of 60 months. Due to its legal binding nature, an IVA has to be set up by a licensed insolvency practitioner. The insolvency practitioners may or may not charge any upfront fees for putting together a client's proposals for an IVA.

When in IVA, the person is already suffering from unbearable debt. That is the reason why lenders are reluctant offer any fresh loans to the concerned person. But, due to the intense competition in the UK loan market, the diversification has taken place.

Once the Insolvency Practitioner understands that an Individual Voluntary Arrangement (IVA) is right for you, you will be asked questions regarding your current financial situation and affordability. Based on the information you have offered, a repayment pattern will be agreed with you. Once proposals have been drawn up you will need to check and sign these and return them to your Insolvency Practitioner. The agreement application is then to the court for an Interim Order. Once this is in place, no lender has the freedom to take legal action against you. A meeting will be arranged to which you should attend. If the creditor who voted against the Individual Voluntary Arrangement (IVA) represents more than twenty five percent of the total debt the person owes, the IVA loans service will fail. This is because an Individual Voluntary Arrangement (IVA) will only ever be approved if lenders having 75% in monetary value is voted in favour. If any of the lenders don't vote, it is assumed that they will vote in favour of the arrangement.

The IVA loans service is suitable for any purpose loans and when someone is unable to pay off their debts but does not want to file for IVA or bankruptcy. It can be an attractive financial option to all parties including the creditors as often it presents for them a better result than under the complete financial collapse like bankruptcy. If the applicant owns his own home he may be required to release any equity in it. This is normally by way of a mortgage or loan secured on it or an extension of the IVA period. The account is administered by the fully qualified, licensed insolvency practitioner, who takes responsibility for liasing with your lenders and distributing funds on your behalf.

The IVA loans service will be legally binding. As long as you keep up the repayments, when the term of your service is finished, you will be free from these debts regardless of how much has been paid off. In simple words, the remaining debt burden is waived. During the period of your service your financial situation will be reviewed at regular intervals to see if there has been any change in your circumstances.
