It is not impossible for any person to be engaged in civil litigation cases. At any point in time, one may experience being a victim of other party’s neglect of duty, fraudulent act and other types of illegal practices. Same as for businesses, since the law considers it as a single entity having its own rights, privileges and responsibilities, a company may sue and be sued in various instances.

The following are some of the possible reasons why businesses engage in civil litigations:

• Neglect of duty
• Unpaid debts
• Fraudulent acts

These scenarios often lead to lawsuits filed in court. However, in some situations, these cases may still be resolved though the process of mediation with the assistance of a qualified business lawyer. Nonetheless, if the infringement or neglect is very critical to the point that the whole company’s operation is at risk, bringing a case in court is the best thing to do.

The main idea of filing a lawsuit is to come up with a just resolution for a conflict. Thus, it is necessary for a neutral party or a court judge to deeply examine all the information and merits of the case. This is the main reason why both parties, the plaintiff and the defendant, in a civil litigation are required to present their evidences and defenses for that matter.

Primarily, the plaintiffs carry the burden of proof since they are the parties complaining. They are then expected to prove their case by presenting as much evidences as they can. These may be in form of documents or statements from witnesses. Afterwards, the defendants will be given a chance to answer the allegations against them. The presiding judge will base his decision depending on the case information gathered.

On the other hand, the plaintiffs or the accusers have a limited time to file their charges under the statutes of limitation. If they were not able to file their lawsuits before the period set by the law, they will not be able to pursue such case in the future – preventing them from obtaining justice or acquiring what they should have got from their cases.

In a civil litigation, a lawyer also plays major role in resolving a case. This goes with the belief that legal challenges need legal experts; especially, in business disputes, wherein several intricate laws may apply. Hiring a competent legal counsel will ensure that all legal rights are properly protected and observed.
